May 2, 2017:

The Fremont County Board of Supervisors met in regular session on Tuesday, May 2, 2017, in the Fremont County Courthouse Boardroom, with Hendrickson, Hickey, and Graham present.  A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

The board signed a plan prepared by the Fremont County Sheriff to allow him to spend room and board funds that have been collected. This plan was required by Iowa Code to allow the funds to be spent. He will be using these funds to purchase car and body cameras. Motion made by Graham to approve the signing of the agreement. Motion carried unanimously. 

Motion was made by Hickey to allow Chairman Hendrickson to sign 28E’s Agreements with Fremont County Cities for Law Enforcement. Motion carried unanimously. 

Judy Crain, Treasurer, met with the board regarding abating taxes on a parcel that was deleted by the assessor. Delinquent taxes date back to 2003/2004. The company has been defunct for years. Motion made by Hickey to sign the resolution to abate the taxes on parcel number 140140196010000. Motion carried unanimously.

RESOLUTION NO. 2017-29

Resolution Abating Taxes on Deleted Parcel #140140196010000.

WHEREAS, THE Assessor deleted parcel #140140196010000 making taxes due from 2003/2004 through 2015/2016 uncollectable.

IT IS HEREBY RESOLVED that the above described property has been deleted from the tax list of the Fremont County Auditor.  Further, all current and delinquent real property taxes are abated under Iowa Code Section 445.63.

BE IT FURTHER RESOLVED THAT THE Auditor and Treasurer shall enter such change orders required to abate these taxes.

Dan Davis, Engineer, met with the board regarding the signing of a temporary easement agreement with Robbie Kinney for the Thurman Project #STP-S-CO36(75) - - 5E-36. Motion made by Hickey to allow Chairman Hendrickson to sign the temporary easement. Motion carried unanimously. 

Motion was made by Graham to approve the Cigarette/Tobacco/Nicotine/Vapor Permits for the following businesses. Motion carried unanimously.

 (a) Cubby’s Inc.
 (b) The Wilds 

The Recorder’s Monthly Report was approved for April. 

In other business, claims were approved for May 5, 2017.

May 9, 2017:

The Fremont County Board of Supervisors met in regular session on Tuesday, May 9, 2017, in the Fremont County Courthouse Boardroom, with Hendrickson, Hickey, and Graham present.  A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

The board discussed meeting with Jack Reed, INCS Services, who provides human resource and collective bargaining services. Graham will set up an appointment with Reed to come speak to the board about the services that he offers and it will be put on the board’s agenda.

Dan Davis, Engineer, met with the board for several signings. Motion made by Hickey to authorize Chairman Hendrickson to sign an agreement with HGM Associates for additional services regarding J-24 Project. It will be $9,800 more for additional design. Motion carried unanimously. 

Motion made by Hickey to table signing resolution for salaries for supervisory and non-union personnel starting July 1, 2017, due to a typographical error. Motion carried unanimously. 

Motion made by Hickey to allow Chairman Hendrickson to sign Hungry Canyons Agreement for Plum Creek RCB (HC 17-3) and Project Number BRS-CO36(74) - - 60-36. Motion carried unanimously. 

Motion made by Graham to sign Resolution No. 2017-30 to approving hire of William (Billy) Clark as the new Fremont County Golf Course Superintendent. Motion carried unanimously.

RESOLUTION NO.  2017-30

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 9th day of May, 2017, that William (Billy) Clark shall be appointed as Golf Course Superintendent, as requested by Fremont County Conservation Board.  The effective date of employment shall be April 24th, 2017.

At 9:32 a.m., Hickey made a motion to go in to closed session per Iowa Code 21.5(c) to evaluate the professional competency of an individual whose appointment, hiring, performance or discharge is being considered when necessary to prevent needless and irreparable injury to that individual’s reputation. Vote: Hendrickson, aye; Hickey, aye; Graham, aye.  Present were Earl Hendrickson, Randy Hickey, Terry Graham, Engineer Dan Davis, Dee Owen, and HR Representative Renee Von Bokern of Von Bokern Associates via telephone.  At 9:32 a.m., the board went into closed session.  At 10:06 a.m., motion was made by Hickey to go out of closed session. Vote: Hendrickson, aye; Hickey, aye; Graham, aye. Motion made by Hickey to not to act on the employee grievance. Vote: Hendrickson, aye; Hickey, aye; Graham, nay. 

The Sheriff’s Monthly Report was approved for April. 

In other business, claims were approved for May 12, 2017

May 16, 2017:

The Fremont County Board of Supervisors met in regular session on Tuesday, May 16, 2017, in the Fremont County Courthouse Boardroom, with Hendrickson, Hickey, and Graham present.  A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Let the records show that also present were Sandy Parmenter, Hamburg Reporter, Arnold Emberton, IT, Brenda Mintle, Assessor, & Howard Nelson, Weed Commissioner.  

Dan Davis, Engineer, met with the board for the signing of a resolution for salaries for supervisory and non-union personnel starting July 1, 2017. Motion made by Hickey to sign the resolution. Motion carried unanimously.

RESOLUTION 2017-31

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors that the following salaries be in effect commencing on the 1st day of July, 2017, for the supervisory and non-union personnel in the Secondary Road Department.

MAINTENANCE SUPERINTENDENT: $23.26 per hour salary
ADMINISTRATIVE ASSISTANT: $19.61 per hour salary
ASSISTANT TO ENGINEER: $25.63 per hour salary
ENGINEER: $91,489.00 salary

Motion is hereby made by Hickey to adopt this resolution.

The board discussed the overpayment of the previous county farm lease contract with Jay Crom from March 1, 2014 through February 28, 2017. The contract total dollar amount was written incorrectly resulting in Crom overpaying $19,856.60 over 3 years. Motion made by Graham to pay Crom back in full. Motion carried unanimously. This will come out of the General Fund Non-Program Function Line 01000-10030-910-99 per the State Auditor. 

Assessor Brenda Mintle & IT Arnold Emberton met with the board regarding a contract with Pictometry. This will include 2 flights over a 6-year period. The total is $88,178.00 for each flight. The assessor will pay 1/3 and secondary roads will pay 1/3. Motion made by Hickey for the county to pay 1/3 of the cost of the contract with Pictometry International, Corp. from county infrastructure. Motion carried unanimously. 

At 9:15 a.m., Sheriff Kevin Aistrope met with the board regarding his new hire Jordan Lerette Elonich. She will be coming from Webster City, IA. Motion made by Graham to sign Resolution No. 2017-32 approving her hire as a full-time Fremont County Deputy Sheriff. Motion carried unanimously.

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 16th day of May, 2017, that the following individual shall be approved as Deputy for the Fremont County Sheriff’s Department, as requested by Fremont County Sheriff Kevin Aistrope.  The effective date of employment shall be May 20, 2017:

Howard Nelson, Weed Commissioner, met with the board regarding things that he saw in Anderson. He believes this is more of a nuisance abatement issue than a weed issue. Engineer Dan Davis & Sheriff Kevin Aistrope will work together on these notices prepared and served. 

Motion was made by Hickey to approve the Cigarette/Tobacco/Nicotine/Vapor Permits for Pilot Travel Center #238. Motion carried unanimously.  

At 10:00 a.m., Hickey moved to go into Public Hearing on the proposed 2016/2017 budget amendment.  Motion carried unanimously.  At 10:03 a.m. hearing no comments and with no objections, motion was made by Graham to go out of public hearing and approve the budget amendment along with the following Resolution 2017-33.  Hendrickson, aye; Hickey, aye; Graham, aye.  Also present was Sandy Parmenter, The Hamburg Reporter.

Secondary Roads had an increase mainly for seal coat projects. Costs will be covered through balance on-hand & RUTF money for this fiscal year. Sheriff had increases for maintenance and operations expenses. They also amended to spend existing room and board funds for the purchase of car and body cameras and to spend out grant money.

May 23, 2017:

The Fremont County Board of Supervisors met in regular session on Tuesday, May 23, 2017, in the Fremont County Courthouse Boardroom, with Hickey and Graham present.  Let the records show Hendrickson was not present for this meeting. A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Motion was made by Graham to approve the following Resolution 2017-34 regarding noxious weeds.  Motion carried unanimously.

RESOLUTION NO.  2017-34

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 23rd day of May, 2017, that the following order for destruction of noxious weeds be effective immediately.

 1. That each owner and each person in the possession or control of any land in Fremont County shall cut, burn, spray, or otherwise destroy all noxious weeds thereon and shall prevent weed seeds from blooming or coming to maturity, and shall keep said lands free from such growth of any other weeds as shall render the streets or highways adjoining said land unsafe for public travel.

Noxious weeds shall be cut, burned, sprayed, or otherwise destroyed on or before the following dates and as often thereafter as is necessary to prevent seed productions:

Group 1: May 15, 2017 - for Leafy Spurge, Perennial Peppergrass, Sour Dock, Sheep Sorrow
Group 2: May 20, 2017 - for Canada Thistle, Russian Knapweed, Buckhorn, Wild Mustard, Musk Thistle and all other species of thistle
Group 3: June 30, 2017 - for Field Bindweed, Wild Carrot
Group 4: June 30, 2017 - for Horse Nettle, Perennial Sow Thistle, Quack Grass, Butter Print, Puncture Vine, Cocklebur, Bull Thistle and Hemp
Group 5: August 14, 2017- for Shatter Cane and Wild Sunflower

2. That each owner and person in the possession or control of any lands in Fremont County, infested with any noxious weeds, including Quack Grass, Perennial Sow Thistle, Canada Thistle, Field Bindweed, Horse Nettle, Leafy Spurge, Perennial Peppergrass, Russian Knapweed, Hemp, or any species of Thistle, shall adopt a program of weed destruction described by the Weed Commissioner, which in five years may be expected to destroy and will immediately keep under control such infestations of said noxious weeds.

3. That if the owners or persons in possession/control of any land in Fremont County fail to comply with the foregoing order, the Weed Commissioner shall cause this to be done and the expense of said work, including costs of serving notice and other costs, if any, to be assessed against the land and the owners thereof.

Motion was made by Graham to allow Vice-Chairman Hickey to sign the amended 2018 IDOT Budget & Construction Program to match the amended county budget.  Motion carried unanimously. 

Motion was made by Graham to approve the part-time seasonal employee resolution for the Fremont County Golf Course. Motion carried unanimously.

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 23rd day of May, 2017, that Andrea Clark and Marty Weston shall be appointed as golf course part-time seasonal help, as requested by Fremont County Conservation Board.  The effective date of employment shall be May 20th, 2017.

May 30, 2017:

The Fremont County Board of Supervisors met in regular session on Tuesday, May 30, 2017, in the Fremont County Courthouse Boardroom, with Hendrickson, Hickey, and Graham present.  A quorum was declared and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved. The agenda was approved as posted. 

Let the records show that also present were Curt Boyd, Jan Zach, Dan Davis and Troy Housh. 

Jan Zach & Curt Boyd, Trustees of the Mule Slough Drainage District met with the board regarding the progress for the district.  Annexation and Reclassification Public hearings are set for Wednesday, May 30, 2017, at the Percival Community Church. Also, discussed was the current pump operations. 

At 9:30 a.m., Dan Davis, Engineer, met with the board for approval of the following:

Motion made by Hickey to allow Chairman Hendrickson to sign the following resolution for road vacation public hearing regarding a portion of 320th Avenue in Section 8, Township 67, Range 41. Motion carried unanimously. 

RESOLUTION NO. 2017-36

RESOLUTION FOR ROAD VACATION PUBLIC HEARING
Fremont County
Resolution No. 2017-36

WHEREAS, a request has been filed with the County Engineer asking that the action be taken to vacate and close a section of Fremont County Secondary Road, described as follows:

                A portion of 320th Avenue, partially vacated on November 17, 1975 lying on the West line of Section 8, T67N, R41W of the 5th PM, Fremont County, Iowa.  The intention of this road closure is to vacate the remaining 907’ of the public road as now established (original and with modifications.)  Commencing at the SW corner of Section 8, T67N, R41W, thence North 380’ along the West line of Section 8 to the point of beginning.  Then North along said section line to the Southerly right-of-way of County Road 287th Street.

NOW, THEREFORE BE IT RESOLVED that a hearing on the proposed vacation will be held in the Board Room, Fremont County Courthouse, Sidney, Iowa 51652, at 9:00 A.M. on June 13, 2017 in accordance with Iowa Code Chapter 306.

Motion made by Hickey, motion carried unanimously.
