October 2019

October 1, 2019:

The Fremont County Board of Supervisors met in regular session on Tuesday, October 1, 2019, in the Fremont County Courthouse Boardroom, with Graham and Sheldon present. Let the record show that Hickey was not present for this meeting. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board sessions were read and approved.  The agenda was approved as posted. 

Also present for this meeting were Assistant County Attorney Tyler Loontjer, EMC Mike Crecelius, Engineer Dan Davis, Safety Coordinator Jeff Shirley, Doug Friedli with Hometown Pride, and Sandy Parmenter with the Valley News Today. 

Assistant County Attorney Tyler Loontjer met with the board regarding the request for proposal for repairs to the asphalt pad that was damaged at the road department. It was damaged by trucks that hauled in sand for sandbags. Motion by Sheldon to approve the posting of the RFP for the repair of the asphalt pad. Motion carried unanimously.  

At 9:06 a.m., Loontjer left the meeting. 

EMC Crecelius said they received great pictures of Percival and Hamburg breach closures from Sandy Graybill. She told him by email that the coffer dam on Waubonsie Creek is holding. Sheldon stated that he thinks we are a long way off from Highway 2 being impacted by the water. He also said he learned in a meeting with IDOT that the raising of Highway 2 would be around 18 inches of height and a couple of new bridges being put in. They also discussed a berm protecting the business corridor and something to protect the northbound on ramp of I29. Engineer Davis stated they are trying to finish up some rocking projects in that area. He’s trying to get rock in all districts before the snow comes in. There are no other updates on rehabilitation assistance & non-structural alternatives to rehabilitation of flood control projects. There will be continued updates each week. 

Motion by Graham to leave the order in place. Motion carried unanimously. The board will continue to discuss the evacuation order on a week-by-week basis. 

Engineer Dan Davis met with the board for the following signings:

Motion by Sheldon to allow Chairman Graham to sign IDOT payment voucher with HGM Associates for engineering/survey services for J-64. Motion carried unanimously. 

Motion by Sheldon to allow Chairman Graham to sign IDOT payment voucher with HGM Associates on engineering/survey services for J-34 & L-31. Motion carried unanimously. 

The board will hold a special meeting on October 3 at 8:00 a.m. to sign a resolution to approve low bid and accept contracts. This meeting will also allow Chairman Graham to sign contracts and bonds for the J64 project. 

Doug Friedli met with the board to give them updates on Hometown Pride projects. He stated due to funding this may be his last update. He provided the following statistics: Hometown Pride has had 449 community monthly meetings, 129 support organization meetings such as Trees Forever, SWIPCO, Iowa Architects, TAB, FC Community Foundation, and more, 281 citizens are involved and have put forth 12,694 volunteer hours, and there are 6 new community endowments totaling $105,546.00. He also presented their goals and all the additional goals that have been met. The board thanked Friedli for all his work for the communities and the county. 

Treasurer Alise Snyder met with the board regarding painting her office. They would like to paint the wood paneling in their office to clean it up. She would like the county to pay for the paint that is about $125.00. Motion by Sheldon to allow the Treasurer to paint their office leaving woodwork as-is. The funds can come out of the maintenance budget or Department 99 if there is money available. If not, the treasurer will cover the cost from her supply line. Motion carried unanimously. 

Safety Coordinator Jeff Shirley met with the board to discuss a wellness proposal. Shirley discussed the criteria for next year’s wellness program. He would like to start a wellness budget to use for incentives for employees to continue to participate. The proposed amount would be $5,000.00. Motion by Graham to have the auditor to reach out to another county to see how they set this up in their county. Motion carried unanimously.

October 3, 2019:

The Fremont County Board of Supervisors met in special session on Thursday, October 3, 2019, in the Fremont County Courthouse Boardroom, with Graham and Hickey present. Let the record show that Sheldon was not present for this meeting. A quorum was declared, and the meeting officially called to order at 8:00 a.m. The agenda was approved as posted. 

Also present for this meeting were Engineer Dan Davis, Assistant Engineer Robbie Kromminga, and Sandy Parmenter with the Valley News Today. 

Engineer Dan Davis and Assistant Engineer Kromminga met with the board regarding the approval of low bid, acceptance of contracts, and the signing of contracts and bonds for the J64 emergency repairs. Motion by Hickey to approve the following resolution regarding the J64 emergency repairs. Motion carried unanimously.

RESOLUTION NO. 2019-54

RESOLUTION TO ACCEPT LOW BID AND AWARD CONSTRUCTION CONTRACT

WHEREAS, the Fremont County Secondary Roads Department held an emergency letting for construction projects on October 1, 2019, and

WHEREAS, two (2) bid was received for J64 GRADING ER-CO36(82) - - 58-36,

NOW THEREFORE BE IT RESOLVED by the Board of Supervisors of Fremont County that the contract be awarded to MOYA,C.J. & SONS, INC. OF ELKADER, IOWA, for the low bid of $1,396,624.40.  The cost of this project shall be paid from Federal Aid and Farm to Market Funds.

Motion to approve made by Hickey.

October 9, 2019:

The Fremont County Board of Supervisors met in regular session on Wednesday, October 9, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board sessions were read and approved.  The agenda was approved as posted. 

Also present for this meeting were Assistant County Attorney Tyler Loontjer, EMC Mike Crecelius, Assistant Engineer Robbie Kromminga, Fred Gach, Elaine Howard, Beth Lueth, Safety Coordinator Jeff Shirley, Dick McClure, LouAnn Kyle, Ken Brown, Steve Meyer, and Sandy Parmenter with the Valley News Today. 

There are no updates on rehabilitation assistance & non-structural alternatives to rehabilitation of flood control projects. There will be continued updates each week. 

Motion by Graham to leave the order in place. Motion carried unanimously. The board will continue to discuss the evacuation order on a week-by-week basis. 

The board opened bids for the asphalt pad repair. One bid was received from Southwest Iowa Parking Lot Maintenance for a lump sum of $71,500. Motion by Sheldon to accept the bid from Southwest Iowa Parking Lot Maintenance for asphalt pad repair in the amount of $71,500. Motion carried unanimously. 

The board discussed the possibility of a TIF at the I29/Highway 2 corridor.  There will be no action at this time. 

John Connor with St. Cornelius was not present at the meeting. 

Motion made by Hickey to approve the renewal of the Class C/Sunday Sales Beer Permit for The Junction (Cubby’s). Motion carried unanimously. 

Fred Gach met with the board regarding possible tax relief or reassessment for FY 20/21 on his home in Fremont County that he cannot access because the road was washed away in the flood.  Motion by Hickey to ask the Assessor if the property could be reassessed for FY 20/21. Motion carried unanimously.

Assistant Engineer Robbie Kromminga met with the board for two signings:

Motion by Hickey to allow Chairman Graham to sign IDOT payment voucher with HGM Associates for engineering services for NEPA Assistance for the Manti Road Bridge. Motion carried unanimously. 

Motion by Sheldon to allow Chairman Graham to sign IDOT payment voucher with HGM Associates for services for bridge replacement at 310th Avenue over local stream, Bridge RS 9. Motion carried unanimously. 

Motion by Sheldon to approve the signing of the debris removal contract with Southwest Iowa Parking Lot Maintenance prepared by the county attorney.  Motion carried unanimously. 

The board discussed a film location contract with Dorsey Pictures. The company is filming a show regarding a past case in Fremont County and are requesting to film the courthouse for this production. Motion by Hickey to allow Chairman Graham to sign the film location contract with Dorsey Pictures. Motion carried unanimously. 

Safety Coordinator Jeff Shirley met with the board regarding an amendment to the budget for wellness funds for additional incentives.  Motion by Hickey to allow the Safety Coordinator to submit a Budget Amendment to cover the first half of calendar year 2020 wellness incentive programs. Motion carried unanimously. 

Fremont County Hometown Pride met with the board regarding possible funding for half time salary for Hometown Pride Coach Doug Friedli.  Elaine Howard, Beth Lueth, Ken Brown and Dick McClure spoke to the board regarding help they have received from Friedli making Fremont County Hometown Pride successful.  Motion by Graham to open discussions with Friedli regarding a new agreement.  Motion carried unanimously.  

Claims were approved for October 11, 2019

In other business, the Recorder’s monthly report and the Sheriff’s monthly report for September were approved.

October 16, 2019:

The Fremont County Board of Supervisors met in regular session on Wednesday, October 16, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board sessions were read and approved.  The agenda was approved as posted. 

Also present for this meeting were Assistant County Attorney Tyler Loontjer, EMC Mike Crecelius, Engineer Dan Davis, Assessor Brenda Mintle, Steve Meyer, and Sandy Parmenter with the Valley News Today. 

Supervisor Graham stated that we will have a new FEMA Project Manager at the end of the month. Engineer Davis said that the construction company will be moving in at the end of the week on the J64 project. Supervisor Hickey said that FEMA put an estimate for the repairs for Scott Drainage District. They could only estimate them because it is still covered with water. The information is in the Scott Drainage District file. There are no other updates on rehabilitation assistance & non-structural alternatives to rehabilitation of flood control projects. There will be continued updates each week. 

Motion by Sheldon to leave the evacuation order in place. Motion carried unanimously. The board will continue to discuss the evacuation order on a week-by-week basis. 

Engineer Dan Davis met with the board for a signing. Motion by Sheldon to allow Chairman Graham to sign an agreement for construction services with HGM Associates for emergency repairs for County Road J-64. Motion carried unanimously. 

At 9:12 a.m., Treasurer Alise Snyder joined the meeting. 

The board discussed the FEMA HMPG buyout criteria.  The board reviewed the list of questions. Motion by Sheldon to approve buyout criteria as presented today. Motion carried unanimously. 

Motion by Sheldon to have EMC Crecelius call landowners that signed up by the deadline to set the individual dates and times (October 22 from 5pm to 8pm, October 23 from 1pm to 5pm, and October 28 from 5pm to 8pm) for those interested in the buyout program. Motion carried unanimously. 

After presenting the bid to FEMA, they thought the price of the asphalt pad was too high. Tiemeyer was contacted for a breakdown and said the price would go down significantly if the deadline was not so strict. FEMA said they could extend the deadline by their standards. The deadline for the contract was changed to reflect a deadline of May 30, 2020.  Treasurer Snyder stated that she would need notice before the repair as they have drives scheduled through November. Motion by Hickey to allow Chairman Graham to sign the contract for the asphalt pad for the lesser amount of $58,500.00. Motion carried unanimously. 

Regarding the county farm bid repairs, Assistant County Attorney Loontjer advised he spoke to the current contract holder and he is concerned about the possibility of not getting his crops out until spring. Loontjer thinks the best time to put the request for proposal for repairs out will be in the spring instead of right now in case the tenant’s crops aren’t able to be harvested. Motion by Hickey to table county farm repair request for proposal to a later date in the spring. Motion carried unanimously. 

Motion by Hickey to allow Chairman Graham to sign a GAX fund request for payment under CDBG for the Iowa Watershed Approach Project. Motion carried unanimously.

October 22, 2019: Special Meeting

The Fremont County Board of Supervisors met in special session on Tuesday, October 22, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 5:00 p.m. The agenda was approved as posted. This meeting is with individuals to discuss the FEMA Buyout Program. 

Also present for this meeting was EMC Mike Crecelius. Crecelius stated that he needed the board to set out another time frame for the final four property owners to meet with them. Motion by Hickey to meet on October 28th, 2019, at 8:00 a.m. for the additional meetings. Motion carried unanimously.

October 23, 2019:

The Fremont County Board of Supervisors met in regular session on Wednesday, October 23, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board sessions were read and approved.  The agenda was approved as posted. 

Also present for this meeting were EMC Mike Crecelius, Engineer Dan Davis, Cara Morgan with Golden Hills RC&D, Derek Namanny and Hannah Varrie with  Iowa Department of Agriculture, Cindy Bebout with Fremont County FSA, Steve Meyer, Leah Brion, and Sandy Parmenter with the Valley News Today. 

Engineer Davis said that the construction company is starting to fill holes on J64. There are no other updates on rehabilitation assistance & non-structural alternatives to rehabilitation of flood control projects. There will be continued updates each week. 

EMC Crecelius stated that the evacuation order is in place, but it is not stopping anyone from going out and taking things from properties. Hickey stated that it still protects the county from liability. Motion by Graham to leave the evacuation order in place. Motion carried unanimously. The board will continue to discuss the evacuation order on a week-by-week basis. 

Engineer Dan Davis met with the board for signings. Motion by Sheldon to allow Chairman Graham to sign two payment vouchers for HGM Associates for engineering/surveying services for J-34 and L-31 and also for J-64. Motion carried unanimously. 

Motion by Hickey to allow Chairman Graham to sign the resolution to add a new project to the Secondary Road Department 5-Year Plan. Motion carried unanimously. 

Cara Morgan with Golden Hills RC & D met with the board regarding potential locations for the rain gardens for East/West Nishnabotna Watershed Project. Also present for this topic were Derek Namanny and Hannah Varrie with the Iowa Department of Agriculture. They received the grant this spring for the rain garden projects. They are ready to move forward on the project. They would like the board’s input on the location and what they would like it to look like. They will need the layout of the sprinkler system to work around. They would like to present this design in the near future. They also stated they usually like to have a ribbon cutting and may have Secretary of Agriculture Mike Naig attend. The board would like them to use the area where the large tree was lost on the northwest corner of the courtyard. They all agreed they would come back to another meeting to present the design to the board. 

Chairman Graham asked that Hometown Pride contact other entities for assistance in covering the part-time Hometown Pride Coach. He would like to use funds from county betterment for the county’s contribution. Motion by Hickey to allow Chairman Graham to gather more information on the cost of position and move forward. Motion carried unanimously.  

Cindy Bebout and Leah Brion with FSA met with the board about the emergency conservation program. Bebout informed the board about this program. These funds are used to rehabilitate properties that were affected by the flood. Most farmers are waiting to repair and clean up their fields until the levees are repaired to avoid cleaning up and then reflooding. This is not for improvements, but to restore it to pre-disaster condition. They have received approximately 200 applications. This program will run as long as necessary due to the fact that there is still water in some areas.  

Clerk of Court Robin Shirley stopped in to introduce the new magistrate, Eric Checketts, to the board.

October 30, 2019:

At 8:30 a.m. on Wednesday, October 30, 2019, a Department Head meeting was held in the Fremont County Courthouse Boardroom.  Present were Terry Graham, Randy Hickey, Dan Davis, Brenda Mintle, Troy Housh, Naeda Elliott, Tyler Loontjer, Dee Owen, Kevin Aistrope, Jenny McAllister, and Jack Reed.  Topics discussed: Family and Medical Leave Act (FMLA) guidelines, the audit, budget planning, and impacts of the flood on budgeting. 

The Fremont County Board of Supervisors met in regular session on Wednesday, October 30, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board sessions were read and approved.  The agenda was approved as posted. 

Also present for this meeting were Engineer Dan Davis, Assistant County Attorney Tyler Loontjer, Jack Reed with INCS, Steve Meyer, and Sandy Parmenter with the Valley News Today. 

At 9:02 a.m., Hickey made a motion to go into closed session pursuant to Iowa Code 20.17(3). Vote: Graham, aye; Hickey, aye; Sheldon, aye. Present were Chairman Terry Graham, Vice Chairman Randy Hickey, Member Dustin Sheldon, Auditor Dee Owen, Engineer Dan Davis, Sheriff Kevin Aistrope, and Jack Reed of INCS.  At 9:02 a.m., the board went into closed session. At 9:08 a.m., Assistant County Attorney Tyler Loontjer joined the meeting. At 9:14 a.m., motion was made by Sheldon to go out of closed session. Vote: Graham, aye; Hickey, aye; Sheldon, aye. 

Engineer Davis said that the construction company has their surfacer working on J-64. He is hoping that it will be the haul route soon. They are trying to get J-10 opened safely for access to the interstate.  Graham briefly stated that the board has been having buyout meetings and he is working on possible housing projects. There are no other updates on rehabilitation assistance & non-structural alternatives to rehabilitation of flood control projects. There will be continued updates each week. 

The board discussed that there was little change in condition of the flood area. Motion by Graham to leave the evacuation order in place. Motion carried unanimously. The board will continue to discuss the evacuation order on a week-by-week basis. 

Assistant County Attorney Loontjer has reviewed the contract for the demolition presented by SWIPCO. Motion by Hickey to allow Chairman Graham to sign contract with SWIPCO for Flood Related Property Acquisition and Demolition Program. Motion carried unanimously. 

Engineer Dan Davis met with the board regarding several signings.

Motion by Hickey to allow Chairman Graham to sign a contract with HGM Associates for engineering services for J-10 emergency repairs. Motion carried unanimously. 

Motion by Sheldon to allow Chairman Graham to sign resolution to add J-10 emergency repair project to Fremont County Secondary Road Department’s 5-Year Plan. Motion carried unanimously. 

Motion by Hickey to allow Chairman Graham to sign IDOT payment voucher with HGM Associates for engineering services for bridge replacement at 310th Avenue. Motion carried unanimously. 

Motion by Sheldon to allow Chairman Graham to sign IDOT Payment Voucher with HGM Associates for Engineering Services for NEPA assistance for Manti Road bridge. Motion carried unanimously. 

The board opened bids that were received for the county farm. There were two bids received. One bid was in the amount of $225.00 per acre. The other bid was for $250.00 per acre. Motion by Sheldon to accept the high bid of $250.00/acre from Jared Moyer. Motion carried unanimously.

The board held more discussion regarding the buyout program. There is not hard deadline, but the sooner the board moves the more funding is available from the flood funds. EMC Crecelius has been asked to submit an estimate of what buyouts might cost to The Department of Homeland Security. The board discussed possibilities of purchasing the land to make the landowner whole or almost whole, then rehabilitating the property for sale. They also discussed getting funding to purchase properties that are adjacent to state ground and having conservation use it as a campground. Supervisor Sheldon voiced concerned about funds for land acquisition. The board discussed holding off on a decision until appraisals could be done or submitting the list for buyout and then doing leg work for other options. Supervisor Graham said he would do some of the follow-up for properties that had other options than the buyout. The board will discuss the buyouts more on their special meeting on November 1st.

November 1, 2019: 

The Fremont County Board of Supervisors met in special session on Friday, November 1, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 8:01 a.m. The agenda was approved as posted. This meeting is with individuals to discuss the FEMA Buyout Program. 

The board discussed the buyout program. They discussed the loss of valuation and tax revenue. The board discussed the need to think outside the box to bring in revenue. They also would like to do some follow-up on possible adjacent landowners purchasing property. The board stressed the need for the county to have the funds secured to pay for their 15% of the buyouts. Without that, they cannot move forward. They would like to gather more information on the financials of the county. 

Supervisor Graham stated that the county must have money in place to pay for the buyouts before they can be granted.  

Motion by Sheldon start the appraisal process for the houses being considered for buyouts. Motion carried unanimously. 

Motion by Hickey to table buyout process pending appraisals. Motion carried unanimously. 

At 8:41 a.m., there being no further business, Hickey made a motion to adjourn. Motion carried unanimously.
