January 2, 2019:

The Fremont County Board of Supervisors met in regular session on Wednesday, January 2, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present.  A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted. 

Let the records show that Treasurer Alise Snyder and Sandy Parmenter with the Valley News Today was present for this meeting. 

The board approved the following resolutions to reorganize the board for 2019:

RESOLUTION NO. 2019-1

WHEREAS, motion was made by Hickey to appoint Terry Graham, Board Chairman and Randy Hickey as Board Vice Chairman.

WHEREAS, the Board Chairman may make motions and vote as any other member of the Board.

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 2nd day of January, 2019, that Supervisor Graham is appointed Board Chairman and Supervisor Hickey is appointed to the position of Vice-Chairman.

RESOLUTION NO.  2019-2

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 2nd day of January, 2019, that the 2019 committee appointments are as follows:

Supervisor Sheldon – Welcome Center Board, West Central Development, Landfill Commission, Local Emergency Response, Southwest Iowa Juvenile Emergency Services Board, Loess Hills Alliance, and Safety Committee.

Supervisor Hickey – DECAT Board, DHS Service Advisory Board, Emergency Management Commission, Waubonsie Mental Health, Regional Planning Affiliate Board, Board of Health, Clarinda Mental Health Center Advisory Board, Workforce Development, and REAP Commission.

RESOLUTION NO. 2019-3

At 9:21 a.m., motion made by Hickey to go into closed session pursuant to Iowa Code 21.5(1)(c) in a matter where litigation is imminent. Vote: Hickey, aye; Graham, aye; Sheldon, aye.  Present were Chairman Terry Graham, Vice Chairman Randy Hickey, Member Dustin Sheldon, Treasurer Alise Snyder, Auditor Dee Owen, and Attorney Naeda Elliott was present by telephone. At 9:28 a.m., motion was made by Hickey to go out of closed session. Vote: Hickey, aye; Graham, aye; Sheldon, aye. Motion made by Graham to make an offer to credit the future taxes or reimburse taxes on Parcel No. 060060123000000 in the amount of $1,487.00 according to Iowa Code Section 445.60. Motion carried unanimously.  

Motion made by Hickey to reappoint Graham to the SWIPCO Policy Council. Motion carried unanimously.  

Motion made by Graham to reappoint Hickey as the alternate to SWIPCO Policy Council. Motion carried unanimously. 

Motion made by Hickey to table appointment of another member to SWIPCO Policy Council. This member is typically someone in public leadership, economic and business development, employment and training, health and human services, business, or education. Motion carried unanimously.

January 8, 2019:

The Fremont County Board of Supervisors met in regular session on Tuesday, January 8, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present.  A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted. 

Let the records show that Sandy Parmenter with the Valley News Today was present for this meeting. Also present for this meeting were John Askew, Mark Birkby, Curt Boyd, Jan Zack, and Brian Johnson. 

Motion made by Hickey to approve the resolution to appoint a temporary special prosecutor. Motion carried unanimously.

RESOLUTION NO. 2019-7

WHEREAS, Fremont County has experienced a temporary vacancy in the position of Deputy County Attorney; and

WHEREAS, the temporary vacancy is scheduled to end February 25, 2019, when the Deputy County Attorney Tyler Loontjer returns from military training; and

WHEREAS, a Special Prosecutor is required for previously scheduled hearings on January 23, 2019 in Fremont County that conflict with other previously scheduled hearings at which the County Attorney must be present;

WHEREAS, the County Attorney may require the assistance of a licensed attorney for other matters during the Deputy’s military leave;

BE IT RESOLVED BY THE FREMONT COUNTY BOARD OF SUPERVISORS that any attorney of the Pottawattamie County Attorney Office’s, is appointed to assist the Fremont County Attorney, at her discretion for any task that may benefit Fremont County, with reasonable attorney fees as authorized by the District Court, effective January 1, 2019, and expiring February 24, 2019, not to exceed the sum budgeted for the Deputy County Attorney during that period of time.

Motion made by Hickey to approve the following resolution regarding 2019 certified utilities.

RESOLUTION NO. 2019-8

BE IT HEREBY RESOLVED by the Fremont County Board of Supervisors this 8th day of January 2019, that the 2019 utilities as certified to the Auditor by the Iowa State Department of Revenue and Finance be approved, collected, and disposed of as regular taxes, according to taxing district.

John Askew of Missouri Valley Drainage District met with the board regarding the court case with Mule Slough Drainage District. Also attending with him was Mark Birkby from MVDD. He discussed the lack of approval to install the pumps in Mule Slough Drainage District & former West Benton Drainage District. He also discussed concerns of threats that were made to block the water on two of the ditches. He stated that MVDD has maintained the ditch since 1924. They plan to continue to maintain the ditch. In closing, he wanted to make the supervisors aware of the court ruling. Curt Boyd stated that their attorney is filing a motion for clarification of the ruling.  

Motion was made by Hickey to approve the time and date for the public hearing for the amendment of the 2018/2019 Fremont County Budget. The hearing date is January 29, 2019 at 9:30 a.m.  Motion carried unanimously.   

Motion made by Sheldon to approve the following resolution appointing Fremont County’s Eminent Domain Compensation Commission.

January 15, 2019:

The Fremont County Board of Supervisors met in regular session on Tuesday, January 15, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present.  A quorum was declared, and the meeting officially called to order at 9:02 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted. 

Let the records show that Treasurer Alise Snyder and Sandy Parmenter with the Valley News Today was present for this meeting. 

Cara Morgan with Golden Hills RC & D, George Parish & Rick Wilson with JEO met with the board regarding a request for extension of the watershed planning contract for 90 days. The Iowa Flood Center produced a report in April of last year, but JEO didn’t receive the report until December. They would like an extension to June 30, 2019. Morgan has the original timeline, and this was built into that timeline. Motion made by Hickey to extend the deadline. Motion carried unanimously. They also discussed an archaeological review/consultation. They would like to move forward with the procurement process for archaeological review/consultation as it is required. Motion by Hickey to move ahead with the procurement. Motion carried unanimously.  

Engineer Dan Davis met with the board for the signing of contracts and bonds. Motion by Hickey to allow Chairman Graham to sign contracts and bonds on Project #L-5-17-1 - - 73-36, 180th Street box. Motion carried unanimously. 

At 9:10 a.m., Chief Deputy Steve Owen joined the meeting. At 9:13 a.m., Sheriff Kevin Aistrope joined the meeting. 

Treasurer Alise Snyder met with the board for the approval of the semi-annual report. Motion by Graham to approve the semi-annual report. Motion carried unanimously. 

Motion made by Hickey to allow Chairman Graham to sign the GAX Form to draw from the CDBG Grant for the East and West Nishnabotna Watershed Project. Motion carried unanimously. 

The Compensation Board met on December 12, 2018. They recommended that all elected officials receive a 2% raise for FY 2019/2020. Motion by Hickey to follow compensation board recommendation of 2% salary increase for 2019/2020. Motion carried unanimously. 

Motion by Sheldon to approve the following tax abatement resolution for the City of Farragut. Motion carried unanimously.

RESOLUTION NO.  2019-10

RESOLUTION ABATING TAXES ON LAND OWNED BY CITY OF FARRAGUT

WHEREAS, the City of Farragut now owns certain property in Farragut, Fremont County, Iowa, Parcel Number for the concerned property is:  420420220000000, described as Lot 2 and South 30 ½ feet of Lot 25 in U.D. Coy’s Second Addition to Town of Farragut, Fremont County, Iowa, according to the recorded plat thereof.

WHEREAS, the property is now owned by the City of Farragut and therefore should not be on the tax rolls according to Section 427.1(2), Code of Iowa,

IT IS HEREBY RESOLVED that the above described property shall be listed as exempt on the tax list of the Fremont County Auditor.  Further, all current and delinquent real property taxes are abated under Iowa Code Section 445.63.

BE IT FURTHER resolved that the Auditor and Treasurer shall enter such change orders required to abate these taxes.

Safety Coordinator Jeff Shirley met with the board to discuss a safety reporting issue. He made a complaint about an interaction with Chief Deputy Owen at the Sheriff’s Office on January 8th regarding a property damage accident that occurred on January 7th. The board heard from both parties. Supervisor Graham suggested that Shirley’s point of contact for safety issues be with the safety committee member at the Sheriff’s Office. The board will look in to clarifying the safety coordinator position.  

In other business, the Recorder’s & Sheriff’s monthly reports for December were approved.

January 22, 2019:

The Fremont County Board of Supervisors met in regular session on Tuesday, January 22, 2019, in the Fremont County Courthouse Boardroom, with Hickey and Sheldon present. Let the records show that Supervisor Graham was not present for this meeting.  A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted. 

Let the records show that Sandy Parmenter with the Valley News Today was present for this meeting. 

The Mills County Board of Supervisors phoned in to discuss the shared county attorney benefits. The contract states one-fifth to not over one-half. It also states it is for health insurance. The boards want clarification of what insurance is covered and the amount. Both boards agreed that Fremont County will pay one-third of the health insurance policies for Elliott & Loontjer for this year so as not to go over budget. The following year the amount will go up to one-half of the health insurance policies. Mills County will continue to pay 100% their dental and vision insurance. The agreement can be revised as needed in the future. Motion made by Sheldon to approve that Fremont County will pay one-third of health insurance policies the attorneys for FY 2018/2019 and then one-half of health insurance in FY 2019/2020.  

Assistant Engineer Robbie Kromminga met with the board for a signing. Motion made by Sheldon to allow Vice-Chairman Hickey to sign IDOT Payment Voucher for HGM Associates on Project # STP-S-CO36(75) - - 5E-36. Motion carried unanimously. 

At 9:24 a.m. the board canvassed the 2019 Drainage Elections held on January 19th, 2019. Motion made by Sheldon to approve the results. Motion carried unanimously.

January 29, 2019:

The Fremont County Board of Supervisors met in regular session on Tuesday, January 29, 2019, in the Fremont County Courthouse Boardroom, with Graham, Hickey, and Sheldon present. A quorum was declared, and the meeting officially called to order at 9:00 a.m. Minutes of the previous board session were read and approved.  The agenda was approved as posted.

Motion made by Hickey to appoint Pat Sheldon to the Civil Service Commission to fill the vacant position. Graham, aye; Hickey, aye; Sheldon, abstain. Motion carried. 

John Thomas with Hungry Canyons Alliance & Golden Hills RC & D met with the board regarding the Hungry Canyons Alliance Program. He explained the reason that Hungry Canyons Alliance to exist. He talked about the straightening of the Nishnabotna Rivers. Stream bed degradation has occurred in 19 counties. The way to stop the cutting of the rivers is through grade control structures. Fremont County has received about $1.35 million in cost shares through the program in the last 20 years. The executive committee asked him to come today due to the turnover in all counties. They want him to brief the boards on their program since he hasn’t been to the counties in some time. They also would like the board to lobby the legislature for an appropriations bump. They want counties to continue to apply for funding. The last reason they asked him to come was to explain to the board why dues have been slowly raised to $4,000 over the years. All 19 counties pay $4,000 and that covers all costs including salary, lights, car, etc.  

Motorola submitted a change order for the ISICS Radio Project. This changes the completion date to December 2, 2019. The change is due to the delay in the signing of the contract on October 24, 2018. The original completion date was set for September 5, 2019. Motion by Hickey to allow Chairman Graham to sign change order CO-01. Motion carried unanimously. 

At 9:30 a.m., Hickey moved to go into public hearing on the proposed 2018/2019 budget amendment.  Motion carried unanimously.  At 9:33 a.m., hearing no comments and with no objections, motion was made by Hickey to go out of public hearing. Motion carried unanimously. 

Motion made by Hickey to approve the budget amendment along with the following Resolution 2019-11.  Graham, aye; Hickey, aye; Sheldon, aye.
